1. Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "Customer," or "User") and Ascend Vacation Group ("we," "us," or "our"). By accessing our website, using our mobile applications, or booking travel services through us, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use our services or book travel with us.

2. Our Role as an Agent
Ascend Vacation Group acts solely as a booking agent for third-party travel suppliers, including but not limited to airlines, cruise lines, hotels, car rental agencies, and tour operators ("Suppliers").

No Liability for Suppliers: We do not own, operate, manage, or control these Suppliers. We are not liable for their acts, errors, omissions, representations, warranties, breaches, or negligence, nor for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.
Supplier Terms: Your booking is also subject to the specific terms and conditions of the relevant Suppliers (e.g., the airline’s carriage contract or the hotel’s cancellation policy).
3. Booking, Payments, and Cancellations
Pricing: Prices and availability are subject to change without notice until full payment is received and the booking is confirmed.
Payments: You authorize Ascend Vacation Group (or our third-party payment processors) to charge your credit card for the total amount of your booking.
Cancellations & Refunds:

Travel bookings are often non-refundable and non-transferable.
Any cancellation or change requests must be made in writing.
If a refund is permitted by the Supplier, it will be processed according to the Supplier’s policies. Ascend Vacation Group may charge an administrative fee for processing cancellations or changes, in addition to any fees charged by the Supplier.
4. Travel Documents and Health
It is the sole responsibility of each traveler to obtain and carry a valid passport, visa(s), and all other documents required by applicable government regulations.

Passports: Must be valid for at least six (6) months beyond your return date.
Entry Requirements: You are responsible for verifying entry requirements (including health and vaccination protocols) for your final destination and any layover countries.
Denial of Entry: Ascend Vacation Group is not responsible if you are denied entry to any country or boarding on any carrier due to failure to carry correct documentation.
5. Mobile Message Service Terms (SMS/Texting)
By consenting to Ascend Vacation Group’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Ascend Vacation Group through your wireless provider to the mobile number you provided.

Service Description: Text messages may include booking confirmations, itinerary updates, payment reminders, and marketing offers.
Opt-Out: You can cancel the SMS service at any time. Just text "STOP" to the short code or number provided. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.
Help: If you are experiencing issues with the messaging program, you can reply with the keyword "HELP" for more assistance, or you can get help directly at privacy@ascendvacationgroup.com.
Costs: Message and data rates may apply for any messages sent to you from us and to us from you.
Carrier Liability: Carriers are not liable for delayed or undelivered messages.
6. Disclaimer of Warranties and Limitation of Liability
No Warranties: Our services and website are provided on an "as is" and "as available" basis.
Force Majeure: Ascend Vacation Group shall not be liable for any failure or delay in performance caused by circumstances beyond our control, including but not limited to acts of God, war, strikes, labor disputes, weather conditions, pandemics, government orders, or mechanical breakdowns.
Liability Limit: To the maximum extent permitted by law, in no event shall Ascend Vacation Group be liable for any special, consequential, indirect, incidental, or punitive damages. Our total liability to you for any claim arising out of or relating to these Terms or your use of our services shall not exceed the amount paid by you to us for the specific booking giving rise to the claim.
7. Indemnification
You agree to defend and indemnify Ascend Vacation Group and its affiliates, officers, directors, employees, and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties, or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of your breach of these Terms or the documents referenced herein, your violation of any law or the rights of a third party, or your use of this website.

8. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Utah for the resolution of any disputes.

9. Changes to These Terms
We reserve the right to modify these Terms at any time. Your continued use of our services following the posting of changes will mean that you accept and agree to the changes.
